Information for interested parties, our customers, external vendors and applicants

We collect and process personal data as part of our business relationship, i.e. data of customers, suppliers and other service providers, directly from the data subject and with their cooperation.

In exceptional cases we may obtain personal data of our customers, suppliers and other service providers from a third party (so-called “third-party data collection”). In such a case, you as the data subject will be informed immediately in accordance with the legal obligation under Article 14 of the GDPR. This involves the categories of your personal data that we obtained from the third party and information on the source where the data comes from and, where applicable, whether it comes from publicly available sources.

Collecting and processing data of our business partners is carried out for the performance of our contracts or in order to take steps prior to entering into a contract (Art. 6(1)(b) of the GDPR). The purposes of data processing mainly depend on the products and/or services ordered. Beyond that, collecting and processing data is carried out as part of all auxiliary transactions that enable us to perform the services or that are even a prerequisite for performing them (e.g. labour-law, tax-law, social-security-law, security-related transactions), including the taking of steps at the request of the data subject prior to entering into a contract.

Data of employees of interested parties, our customers and external service providers whose personal data we collect as part of the above purposes as contact persons, are processed by us only to the extent necessary for the purposes of our legitimate interests (Art. 6(1)(f) of the GDPR); this involves in particular: the first name, last name, form of address and, where appropriate, function of the contact person.

Based on Art. 6(1)(f) of the GPDR, we process personal data for the purposes of our or third parties’ legitimate interests beyond the actual performance of the contract and/or taking of steps prior to entering into a contract. Such legitimate interests include for example:

  • measures for building and system security (e.g. access controls)
  • measures to ensure domiciliary rights
  • measures for business management and further development of services and products
  • data collection and processing to comply with a legal obligation that we are subject to (Art. 6(1)(c) of the GDPR)
  • establishment of legal claims and defence in legal disputes
  • safeguarding of IT security and of the IT operation of our data processing systems
  • prevention and investigation of crimes

In addition, as a production company and employer, we are subject to various legal obligations, i.e. statutory requirements (e.g. arising from technical standards, under social security laws, occupational safety and health laws, and tax laws).

Beyond that, data collection and processing is carried out only with the explicit consent (Art. 6(1)(a) of the GDPR) of the data subject for specifically defined purposes. The lawfulness of this processing is then based on such consent. Any consent given may be withdrawn at any time. This also applies to withdrawing declarations of consent given to us before the GDPR became applicable, i.e. before 25 May 2018. Withdrawal of consent is only effective for the future and does not affect the lawfulness of data processing until the withdrawal was declared.

Those functions within the company that need your data for fulfilling our contractual and legal obligations are given access to them. Service providers and vicarious agents used by us and such organisations that process your personal data in accordance with our instructions (so-called “processors”) may also receive data for those purposes. These are companies in the categories of credit services, IT services, logistics, printing services, telecommunication, debt collection, consultancy, distribution and marketing, taxes, social security and employment services. Public authorities may also be recipients if legal or regulatory obligations to that effect exist. Other recipients of data may be those organisations or bodies that you have given us your consent to share data with or that we are authorised to transfer personal data to following the balancing of interests.

We will delete personal data if it is no longer necessary in relation to the purposes for which it was collected or otherwise processed. Thus, the purpose of data processing determines the permitted period of storage of processed data. In addition, we are subject to the statutory retention periods under the German Commercial Code (HGB) and will delete your data at the end of these periods.

Information for applicants

If you decide to apply for a job with our company, we will store and process your data exclusively for the purpose of filling vacancies within our company on the basis of Art. 88(1) of the GDPR in conjunction with section 26(1) of the German Federal Data Protection Act (BDSG). The following data is collected:

  • master data (first name, last name, additions to names, date of birth)
  • address information
  • contact information (telephone numbers, fax number, email address)
  • where applicable, work permit, residence permit
  • application documents (letter of application, CV, certificates, references, etc.)

As a matter of principle, your data will be shared internally only with the in-house functions and specialist departments of VEROTEX AG competent for the recruitment process. They will not be shared with any third parties.

If employment results from your application, we will transfer your application documents to your personnel file. If no employment relationship comes into existence, your application data will be deleted no later than 6 months after the recruitment process is completed. If, due to your profile, your application might be interesting for future job vacancies, we will store your application data only if you have given us your explicit consent to do so. In this case, your application data will be deleted after a period of 12 months.

Amendment to our data protection provisions

We reserve the right to adjust this privacy notice so that it always complies with the current legal requirements or in order to implement changes to our services in the privacy notice, e.g. when new services are introduced. In such a case, the new privacy notice will apply to your new visit.
